RELEASE AND WAIVER AND INDEMNITY AGREEMENT
I understand that participating in the Quick ‘n Dirty MTB Race Series is potentially hazardous, and I should not register and participate unless I am physically prepared and medically able to perform. I assume complete responsibility for any injury or accident which may occur while I am traveling to or from the event, during the event or while I am on the premises of the event at the San Dieguito River Park, Black Mountain Open Space, Sycamore Canyon Open Space, Balboa Park, Cleveland National Forest, Lake Morena County Park, Barona MX Track or any other location of an event. City of San Diego, its respective elected officials, officers, employees, agents and representatives.
I also fully assume and am fully aware of the risks associated with participating in this event. Those risks include, but are not limited to, the following: effect of weather, contact with other participants, traffic, obstacles of nature and road/trail conditions, severe bodily injury and death. I, as well as my heirs and executors, hereby waive, release and forever discharge Quick ‘n Dirty MTB Race Series organizers, the San Dieguito River Park, Black Mountain Open Space, Sycamore Canyon Open Space, Balboa Park, Cleveland National Forest, Lake Morena County Park, Barona MX Track, Joint Powers Authority, sponsors, medical personnel, volunteers, underwriters, land owners and managers, promoters and each of their agents, representatives, successors and all persons associated with the event from any and all claims, liabilities, actions and damages that I might have against them originating in any way with participation in this event. I HEREBY WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND PROMISE TO INDEMNIFY AND NOT TO SUE the Releasees and all sponsors,organizers and promoting organizations, property owners, law enforcement agencies, public entities, special districts and properties that are in any manner connected with these events, and their respective agents,officials,and employees through or by which the events will be held,(the foregoing are also collectively deemed to be Releasees)
By signing and participating in this event, I understand I am giving up substantial legal rights and that this release is a contract with legal and binding consequences that apply to all races and activities at this event, regardless of whether or not it is aforementioned. I have carefully read this waiver and fully understand what I am agreeing to. I also agree release all claims, regardless of whether they are known or unknown, and specifically agree to waive any protection that might exist under provisions of California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
I agree I will wear an approved helmet and eye protection at all times. I can verify that my physical condition is medically sufficient to participate in the physically strenuous activity of mountain biking. I understand the entry fee is non-refundable and non-transferable, and realize the event can be canceled or re-routed depending on weather conditions. I also grant full permission for Quick ‘n Dirty MTB Race Series to use email that you provide, any photographs, video, website images, and any other media for promotional purposes.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT In consideration of being allowed to participate on behalf of in this particular competition, race, related events and/or activities (collectively, Quick n Dirty mtb events or Barona MX Sports park. (“eDirty Cross, Winter Series Dirty 30”) I, the undersigned, acknowledge, covenant and agree that:
1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While parAcular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (insert name of sports organization) their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
