THE JOLLY JOG 5K
PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT
PLEASE READ CAREFULLY. BY REGISTERING FOR OR PARTICIPATING IN THE JOLLY JOG 5K, YOU ARE AGREEING TO RELEASE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE.

1. Release of Liability
In consideration of being permitted to register for and participate in The Jolly Jog 5K (the "Event"), presented by Fleet Feet Cincinnati in partnership with Cincy Run Club, I, the undersigned participant, voluntarily and knowingly agree to waive, release, discharge, and hold harmless Fleet Feet Cincinnati, Cincy Run Club LLC, and their respective owners, affiliated entities, partners, members, officers, directors, employees, agents, representatives, contractors, event directors, race organizers, volunteers, sponsors, and their respective successors and assigns, together with RunSignup.com and its applicable representatives (collectively, the "Released Parties"), from any and all claims, demands, actions, damages, losses, expenses, or liabilities arising from or related to my participation in the Event, including claims for personal injury, illness, disability, death, or property damage.

I EXPRESSLY UNDERSTAND AND AGREE THAT THIS RELEASE INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF FLEET FEET CINCINNATI, ITS PARTNERS, AND THE OTHER RELEASED PARTIES, including alleged negligent planning, organization, supervision, course selection, course marking, communication, or failure to identify or warn of hazards, to the fullest extent permitted by applicable law.

This release applies to incidents occurring before, during, or after the Event that arise from participation in or attendance at Event-related activities.

This agreement does not purport to waive claims that cannot lawfully be released under Ohio law.

I understand that this release is intended to bind me and, to the extent permitted by law, my heirs, executors, administrators, personal representatives, and assigns.

2. Acknowledgment and Assumption of Risk
I understand that participation in running, walking, and other physical activities involves inherent and foreseeable risks, including but not limited to:

Slips, trips, falls, collisions, and physical contact with other participants or members of the public.
Uneven, cracked, damaged, icy, wet, slippery, obstructed, or otherwise hazardous sidewalks and walking surfaces.
Motor vehicle traffic, including vehicles entering or exiting intersections, driveways, parking areas, and roadways.
Collisions with vehicles, bicycles, scooters, pedestrians, animals, or other participants.
Adverse weather conditions, including rain, snow, ice, wind, extreme temperatures, and reduced visibility.
Physical exertion, dehydration, exhaustion, cardiac events, illness, or other medical emergencies.
Inadequate lighting, unexpected obstacles, changing course conditions, and the actions or omissions of third parties.
Serious bodily injury, permanent disability, paralysis, or death.
I voluntarily assume the risks associated with participating in the Event, whether known or unknown, foreseeable or unforeseeable, including risks arising from the ordinary negligence of the Released Parties, to the extent permitted by law.

I acknowledge that participation is entirely voluntary and that I may withdraw from the Event at any time.

3. Sidewalk-Based Course and Traffic Laws
I ACKNOWLEDGE THAT THE JOLLY JOG 5K IS A SIDEWALK-BASED EVENT CONDUCTED IN AN ACTIVE PUBLIC ENVIRONMENT. ROADS WILL REMAIN OPEN TO VEHICLE TRAFFIC, AND THE COURSE IS NOT A CLOSED-ROAD OR TRAFFIC-FREE RACE.

I understand and agree that:

I must follow all applicable federal, state, and local laws, including pedestrian and traffic regulations.
I must remain on designated sidewalks, pedestrian pathways, or other authorized portions of the course unless otherwise directed by authorized personnel.
I must obey all traffic signals, pedestrian crossing signals, signs, and lawful instructions from public safety officials.
I must use designated crosswalks when crossing streets and must not enter an intersection or roadway unless it is safe and legally permissible to do so.
I must yield as required by law and exercise reasonable caution around vehicles, bicycles, scooters, pedestrians, and other public traffic.
I understand that race participation does not grant me the right of way or exempt me from traffic laws.
I am responsible for maintaining awareness of my surroundings, including traffic, weather, surface conditions, and other potential hazards.
I must not allow competition, pace, race position, or the desire to achieve a particular finishing time to interfere with safe and lawful behavior.
I understand that Fleet Feet Cincinnati, its partners, and the other Released Parties do not guarantee traffic control, police presence, intersection closures, unobstructed sidewalks, or a course free from hazards.

I ACCEPT PERSONAL RESPONSIBILITY FOR MY DECISIONS, CONDUCT, AND SAFETY WHILE PARTICIPATING IN THE EVENT.

To the fullest extent permitted by law, I release the Released Parties from claims arising from traffic-related incidents, pedestrian interactions, course conditions, and other risks associated with participation, including those attributable to the Released Parties' ordinary negligence.

4. Participant Health and Physical Fitness
I acknowledge that I am responsible for evaluating my own physical condition and determining whether I am medically and physically capable of participating safely.

I understand that the Event may involve strenuous physical activity and that participation may aggravate preexisting medical conditions.

I agree not to participate if I am aware of a medical condition, injury, illness, or other circumstance that makes participation unsafe.

I understand that the Released Parties do not provide medical examinations, certify participant fitness, or guarantee the availability of medical personnel or emergency services.

I agree to immediately discontinue participation if I experience symptoms or conditions that make continued participation unsafe.

5. Emergency Medical Treatment
In the event of an illness, injury, accident, or medical emergency, I authorize Event representatives to contact emergency medical services and, when reasonably necessary and legally permissible, facilitate emergency medical treatment or transportation on my behalf.

I understand that emergency medical assistance may not be immediately available.

I accept financial responsibility for medical expenses associated with my care, including emergency transportation, physician services, hospitalization, medications, and related treatment.

I understand that the Released Parties are not responsible for paying my medical expenses merely because the injury or illness occurred in connection with the Event.

6. Participant Conduct and Compliance
I agree to comply with all Event rules, safety instructions, and lawful directions given by Event officials, volunteers, and public safety personnel.

I acknowledge that Event organizers reserve the right to deny or terminate my participation if my behavior presents a safety risk, violates Event rules, or interferes with the safe operation of the Event.

I understand that failing to comply with course instructions or traffic laws may result in immediate disqualification or removal from the Event.

I agree to exercise reasonable care for my own safety and the safety of others throughout my participation.

7. Indemnification
To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties against third-party claims, liabilities, damages, judgments, and reasonable legal expenses arising from my negligent, reckless, intentional, or unlawful conduct during the Event, including my violation of traffic laws or Event safety rules.

This indemnification obligation is limited to losses attributable to my own conduct and does not require me to indemnify a Released Party for that party's own negligence or misconduct.

8. Communicable Disease and Public Health Risks
I understand that participation in a group event may involve exposure to communicable diseases, including COVID-19, influenza, and other infectious illnesses.

I voluntarily assume the ordinary risks associated with such exposure and agree to comply with applicable public health requirements and Event safety policies.

I agree not to knowingly attend while experiencing symptoms of a contagious illness that could reasonably endanger other participants.

9. Photography and Media Release
I grant Fleet Feet Cincinnati, Cincy Run Club LLC, and their authorized partners, sponsors, representatives, and event affiliates permission to photograph, film, record, and otherwise capture my participation in the Event.

I authorize the use of my name, likeness, image, voice, and appearance in Event-related promotional materials, advertisements, social media content, publications, videos, and other marketing communications without additional compensation, to the extent permitted by law.

10. Event Changes, Cancellation, and Refund Policy
I understand that all registration fees are nonrefundable unless otherwise expressly required by applicable law.

Event organizers reserve the right to modify, postpone, relocate, shorten, suspend, or cancel the Event due to weather, public safety concerns, governmental restrictions, emergencies, or other circumstances beyond their reasonable control.

I understand that such changes may occur without advance notice when necessary to address immediate safety concerns.

I acknowledge that registration fees are nontransferable unless otherwise expressly authorized by Event organizers.

11. No Guarantee of Safety
I acknowledge that no race, course, or public event can be made completely free of risk.

I understand that the presence of race volunteers, course markings, directional signs, or safety instructions does not constitute a guarantee of my safety or create an assurance that all hazards have been identified or eliminated.

I recognize that the Released Parties cannot control the actions of motorists, pedestrians, cyclists, other participants, or members of the public.

I voluntarily elect to participate despite these limitations.

12. Parent or Legal Guardian Consent for Minors
If the participant is under 18 years of age, I certify that I am the participant's parent or legal guardian and have the legal authority to consent to their participation.

I acknowledge that I have read and understand this agreement, including the risks of participation in an open-road, sidewalk-based running event.

I voluntarily consent to the minor's participation and acknowledge the risks described in this agreement on their behalf.

To the fullest extent permitted by Ohio law, I agree to the releases and assumption-of-risk provisions of this agreement on behalf of the minor participant and release my own claims arising from the minor's participation.

I understand that I remain responsible for determining the minor's ability to safely participate and for arranging appropriate supervision.

13. Governing Law and Severability
This agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio.

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

Any limitation on the enforceability of one provision shall not automatically invalidate the remaining provisions.

14. Acknowledgment and Voluntary Agreement
BY SUBMITTING MY REGISTRATION, I ACKNOWLEDGE AND AGREE THAT:

I have carefully read and understand this entire agreement.
I understand that I am voluntarily giving up certain legal rights, including the right to bring claims against the Released Parties for ordinary negligence.
I understand that the Event takes place on public sidewalks and that roads will remain open to vehicle traffic.
I agree to obey all traffic laws, pedestrian signals, and Event safety rules.
I voluntarily assume the risks associated with participating.
I accept personal responsibility for my own conduct and safety.
I am entering into this agreement freely and voluntarily.
If registering a minor, I certify that I am authorized to consent on their behalf.

I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY AND A LEGALLY BINDING AGREEMENT.

By electronically signing or affirmatively accepting this agreement through the registration platform, I indicate my acknowledgment, consent, and agreement to its terms.
