This Release and Waiver of Liability (the “Release”) by (the “Volunteer”), in favor of the Copper Harbor Trails Society, Inc., also
known as the Copper Harbor Trails Club, and their respective directors, officers, employees, volunteers,
agents, and landowners, including Keweenaw Resort, LLC and KR Property I, LLC, in addition to all directors,
officers, employees, volunteers, and agents of those landowners (collectively, the “Released Parties”). I, the Volunteer, desire to work as a volunteer for one or more of the Released Parties and engage in the activities related to being a volunteer ("Activities"). I understand that my Activities may include but are not limited to the following: planning, constructing, and maintaining trails; operating powered and non-powered hand tools; preparing for and conducting race events; fundraising; and leading group rides or related educational events.
Release and Waiver. I, the Volunteer, release and forever discharge and hold harmless the Released Parties and
their successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in
equity, which arise or may hereafter arise from my participation in the Activities or the services I provide to the Released
Parties. I understand and acknowledge that this Release discharges the Released Parties from any liability or claim that I
may have against the Released Parties with respect to bodily injury, personal injury, illness, death, or property
damage that may result from my participation in the Activities or the services I provide to the Released Parties or
occurring while I am providing volunteer services. I acknowledge that the Copper Harbor Trails Club is responsible for
maintenance of the trails located on the property owned by Keweenaw Resort, LLC or KR Property I, LLC which I may be
performing the Activities on, pursuant to a Trails Easement recorded at 20220175 with the Keweenaw County Register of
Deeds.
Insurance. I understand that the Released Parties do not assume any responsibility for or obligation to provide me with
financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive
any such claim for compensation or liability on the part of the Released Parties beyond what may be offered freely by
the Released Parties in the event of injury or medical expenses incurred by me.
Medical Treatment. I, the Volunteer, do hereby release and forever discharge the Released Parties from any claim or
action whatsoever which arises or may hereafter arise on account of any first aid, treatment or service rendered in
connection with my participation in the Activities or services I provide for with any of the Released Parties.
Assumption of Risk. I understand that my participation in the Activities or work for the Released Parties may include
Activities that may be hazardous. I assume the risk of injury or harm in those Activities I choose to do and release the
Released Parties from all liability for injury, illness, death, or property damage occurring from my participation in the
Activities or work for the Released Parties.
Photographic Release. I grant to the Released Parties the right to use photographic images and video or audio recordings
of me that are made by the Released Parties or others during my assigned Activities for the Released Parties, including
royalties, proceeds or other benefits from the use of the photographs or recordings.
Other. I agree that this Release is intended to be as broad and inclusive as permitted by the laws of Michigan, and that
this Release is governed by and will be interpreted according to the laws of Michigan. I understand that should any part of
this Release be ruled invalid by a court, the other parts will remain valid and continue to be in effect.
I express my understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily
