I understand and acknowledge that all registration fees and donations made to Cycling 4 one·n·ten (C4ONT) are non-refundable and non-transferable. 

I further understand and acknowledge that registration fees help cover the products and services C4ONT provides to riders, including some administrative costs, and are therefore not tax-deductible and do not apply towards fundraising goals.

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY – THIS IS A LEGAL CONTRACT

NOTICE: This document affects your legal rights. By signing below, you are releasing certain parties from liability for injuries that may occur during your participation in Cycling 4 one·n·ten (C4ONT). This release does not apply to claims arising from gross negligence, reckless conduct, intentional acts, or violations of statutory duties including road maintenance obligations.

GENERAL INFORMATION

Cycling 4 one·n·ten ("Event") is a 1-day bicycle ride through Phoenix, Scottsdale, and Paradise Valley, Arizona, produced by and benefiting one·n·ten (1n10, Inc.), an Arizona nonprofit corporation. The Event raises funds towards one·n·ten’s goal of enhancing the lives of LGBTQ+ youth and young adults, ages 11-24, by providing empowering social and service programs that promote self-expression, self-acceptance, leadership development, and healthy life choices. By participating in the Event and/or any pre-season training rides and activities (collectively, the "Activities"), you acknowledge and agree to the terms of this agreement.

PARTICIPANT REQUIREMENTS AND CODE OF CONDUCT

Safety Requirements

I agree to:

• Wear a Consumer Product Safety Commission (CPSC) approved bicycle helmet at all times while riding;
• Obey all Arizona Vehicle Code provisions and local traffic laws, including stopping at all stop signs & stop lights;
• Follow all Event safety protocols and instructions from Event staff and volunteers;
• Maintain my bicycle in safe operating condition; and
• Ride responsibly and within my abilities.

Code of Conduct

I have read and agree to abide by the Safety Requirements listed above, available at https://runsignup.com/Race/c4ont/Page/Safety-Rules-of-the-Road, and the Event’s Code of Conduct, available at https://runsignup.com/Race/c4ont/Page/Code-of-Conduct, which both include requirements for respectful behavior, environmental responsibility, and compliance with all Event rules. I understand that one·n·ten reserves the right, in its sole discretion, to expel me from the Event for violation of safety rules, the Code of Conduct, or any behavior deemed inappropriate or dangerous, without refund or recourse.

ACKNOWLEDGMENT OF RISKS

I UNDERSTAND AND ACKNOWLEDGE that bicycle riding is an inherently dangerous activity that involves risks that cannot be eliminated regardless of the care taken by organizers or the condition of facilities. These inherent and other risks include, but are not limited to:

Traffic and Road Hazards:

• Collisions with motor vehicles, other cyclists, pedestrians, or fixed objects;
• Road surface variations including potholes, cracks, debris, gravel, and pavement irregularities;
• Railroad tracks, cattle guards, rumble strips, bridges, and construction zones; and
• Limited visibility conditions and blind curves.

Physical and Medical Risks:

• Falls resulting in abrasions, fractures, head injuries, paralysis, or death;
• Dehydration, heat exhaustion, heat stroke, hypothermia;
• Cardiac events, respiratory distress, or other medical emergencies;
• Aggravation of pre-existing medical conditions; and
• Overexertion, muscle strains, and repetitive stress injuries.

Equipment and Environmental Risks:

• Mechanical failure of bicycle components;
• Adverse weather including rain, wind, lightning, and extreme temperatures;
• Encounters with animals or insects; and
• Exposure to allergens or environmental irritants.

Event-Specific Risks:

• Riding with participants of varying skill levels and speeds;
• Group riding dynamics and pace lines;
• Limited access to medical care in remote areas;
• Potential delays in emergency response; and
• Communicable disease exposure in group settings.

VOLUNTARY PARTICIPATION

I acknowledge that my participation is purely voluntary. No one is forcing me to participate, and I elect to participate despite and with full knowledge of these inherent dangers.

ASSUMPTION OF RISK

I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISKS associated with my participation in the Activities, whether such risks are described above or not, and whether they arise from:

• The inherent dangers of cycling;
• The ordinary negligence of the Released Parties (defined below);
• Dangerous or defective equipment or property owned, maintained, or controlled by the Released Parties;
• My own actions or inactions; and
• The actions or inactions of other participants or third parties.

I understand that this assumption of risk includes both KNOWN and UNKNOWN risks, and I accept full responsibility for any injury, death, property damage, or other loss arising from my participation.

WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to participate in the Activities, I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE the following parties (collectively, the "Released Parties"):

1. one·n·ten (1n10, Inc.), its directors, officers, employees, agents, volunteers, contractors, and sponsors, including but not limited to Chris & Greg Events LLC dba CG Events;
2. Event sponsors, vendors, and partner organizations;
3. Private property owners who grant permission for Event use; and
4. Event medical personnel and volunteers acting within the scope of their duties.  

Scope of Release

This release applies to all claims for personal injury, death, property damage, or other losses arising from the ORDINARY NEGLIGENCE of the Released Parties, including but not limited to:

• Negligent Event planning, supervision, or conduct;
• Negligent instruction or training;
• Negligent first aid or emergency response;
• Negligent selection or maintenance of Event equipment and supplies; and
• Negligent selection of routes (excluding government road maintenance duties).

IMPORTANT LIMITATIONS

This release applies only to claims arising from ordinary negligence.

I understand this means I am releasing unknown claims that may exist, and I do so voluntarily with full knowledge of this waiver's significance.

INDEMNIFICATION

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, demands, causes of action, damages, costs, expenses (including reasonable attorney fees), judgments, or liabilities arising from:

1. My participation in the Activities;
2. My breach of this agreement or the Code of Conduct;
3. My negligent or intentional acts or omissions; and
4. Claims brought by third parties arising from my conduct.

This indemnification obligation survives the Event and applies regardless of whether claims are based on the Released Parties' ordinary negligence.

MEDICAL TREATMENT CONSENT AND RELEASE

Medical Care Authorization

I authorize Event medical personnel and emergency responders to provide first aid, emergency medical care, and/or transportation as deemed necessary for any injury or illness during the Activities.

Medical Information Release

I authorize release of medical information to:

• Event medical personnel and emergency responders;
• Treating healthcare providers; and
• My emergency contacts listed in my registration.

Financial Responsibility

I accept full financial responsibility for all medical treatment costs, including ambulance transport and hospitalization.

Pre-Existing Conditions

I acknowledge that:

• I am physically capable of participating in this strenuous one-day cycling event;
• I have consulted with healthcare providers regarding any medical conditions that may affect my participation;
• I am responsible for managing my medications and medical needs during the Event; and
• one·n·ten (1n10, Inc.) recommends obtaining appropriate medical and travel insurance.

IMAGE AND PUBLICITY RELEASE

I grant one·n·ten (1n10, Inc.) and its designees the perpetual, worldwide, royalty-free right to:

• Photograph, video record, and audio record my participation;
• Use my name, image, voice, and likeness for promotional purposes;
• Create derivative works incorporating my image or likeness; and
• Distribute such materials in any media now known or later developed.

I waive all rights to compensation and any privacy or publicity rights related to such use.

PARTICIPANT ACKNOWLEDGMENTS AND AGREEMENTS

By signing this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, I acknowledge and agree that:

1. I have carefully read and understand this entire agreement;
2. I am signing this agreement freely and voluntarily;
3. I understand this is a binding legal contract that affects my legal rights;
4. I have had the opportunity to consult with legal counsel of my choosing;
5. I am not relying on any oral representations contrary to this written agreement;
6. This agreement supersedes any previous agreements regarding the Event;
7. If any portion is deemed invalid, the remainder continues in full effect; and
8. This agreement is governed by Arizona law with venue in Maricopa County.

ELECTRONIC DISCLOSURE AND CONSENT

By signing below, I consent to electronic transactions and agree that my electronic signature (including facsimile, email, PDF, or any method complying with the U.S. federal ESIGN Act of 2000) has the same legal effect as my handwritten signature. I understand I have the right to receive paper copies upon request and may withdraw this consent in writing at any time, and I confirm I can access electronic documents using standard software and internet access.

PARTICIPANT CERTIFICATION: I certify that I am at least 18 years of age, have read and understood this agreement, and voluntarily agree to be bound by its terms.

IMPORTANT REMINDERS:

• This document affects your legal rights – read it carefully.
• You are giving up certain legal rights by signing this agreement.
• This release does not cover gross negligence or statutory violations.
• Keep a copy of this agreement for your records.
